Frequently asked questions

How long do we need to be separated before divorcing?

In Jamaica a divorce is generally granted on the basis that the marriage has broken down irretrievably, shown by the spouses having lived apart for at least 12 months before the petition is filed. We can advise on how this applies to you.

How is property divided when a relationship ends?

Under the Property (Rights of Spouses) Act, each spouse is generally entitled to an equal share of the family home, although the court can vary this in certain circumstances. Other property is usually divided according to each spouse’s contribution. The Act can also apply to qualifying common-law relationships.

Will I have to go to court?

Not necessarily. Many custody, maintenance and property matters are resolved through negotiation or mediation. Where agreement is not possible, we will represent you in the Family Court or the Supreme Court.
